Terms and Conditions for Nitti Gritti and Sirenic Activation Kiosks
1. Acceptance of Terms
1.1 By registering for and/or using the Nitti Gritti services or by submitting your details via a Sirenic activation kiosk (including event stands, games, or digital activations), you agree to these Terms and Conditions, our Privacy Policy, and any other relevant policies.
1.2 Sirenic may update these terms periodically, and your continued use of the app or participation in activations signifies acceptance of any changes.

2. User Registration and Account Security (App Users)
2.1 Users must provide accurate and complete registration information.
2.2 You are responsible for maintaining the confidentiality of your login credentials.
2.3 You are responsible for all activities that occur under your account.

3. Use of the App and Kiosks
3.1 Nitti Gritti is designed for event management, including agenda setting, messaging, and file sharing.
3.2 Activation kiosks are designed for short-term promotional use, including games, competitions, or surveys at Sirenic-managed events.
3.3 Misuse of the app or kiosks for unauthorized purposes is strictly prohibited.

4. Content and Conduct
4.1 Users are responsible for their content, including messages, files, or information submitted.
4.2 Prohibited content includes anything illegal, harmful, or offensive.
4.3 Sirenic reserves the right to remove content or block participation that violates these terms.

5. Intellectual Property
5.1 Nitti Gritti, Sirenic activation kiosks, and their original content, features, and functionality are the exclusive property of Sirenic.
5.2 Users retain rights to their content but grant Sirenic a license to use, modify, and display the content as part of the service or activation.

6. Privacy and Data Security
6.1 Our Privacy Policy describes how we handle personal data.
6.2 When using a kiosk, Sirenic may collect personal details such as name, email, phone number, and demographic information. This data may be used to:
Administer participation in the activation (e.g., access to games, prize eligibility, or surveys).
Communicate updates, newsletters, and promotional offers from Sirenic or participating partners (such as Amazon.co.za).
6.3 In the event of a data breach, Sirenic will take appropriate measures to mitigate the breach and notify affected users.

7. Indemnification
7.1 You agree to indemnify, defend, and hold harmless Sirenic and its affiliates, officers, agents, employees, and partners from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of Nitti Gritti, participation in a Sirenic activation kiosk, your violation of these Terms, or your violation of any rights of another.

8. Disclaimers and Limitation of Liability
8.1 Nitti Gritti and activation kiosks are provided "as is" without warranties of any kind.
8.2 Sirenic is not liable for any indirect, incidental, or consequential damages arising from the use of the app or kiosks.

9. Termination
9.1 Sirenic may terminate or suspend access to our services or kiosks immediately, without prior notice, for any reason whatsoever, including without limitation if you breach the Terms.

10. Governing Law
10.1 These Terms will be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.
